Some of it aims to stamp out diversity, equity and inclusion and what he terms \u201cradical gender ideology.\u201d Some of it is aimed at media organizations whose language he dislikes. In other cases, the attacks target opponents who have spoken sharply about the administration.<\/p>\n\n\n\n<p>Together, critics \u2014 and in some cases, judges \u2014 have said Trump\u2019s efforts have gone beyond shaping the message of the federal government to threaten the First Amendment rights of private groups and individuals.<\/p>\n\n\n\n<p>\u201cYou can claim that you are championing expression and are a free-speech supporter, but saying those things doesn\u2019t change what are a number of steps that add up to government censorship,\u201d said Michelle Deutchman, executive director of the National Center for Free Speech and Civic Engagement at the University of California. \u201cThe government is using content-based and even viewpoint-based discrimination to make decisions about what words and thoughts people can express.\u201d<\/p>\n\n\n\n<p>Trump\u2019s orders banning DEI efforts threaten organizations receiving federal money if they advocate for diversity and inclusion. That violates the First Amendment, a<a href=\"https:\/\/www.washingtonpost.com\/business\/2025\/02\/21\/trump-dei-executive-order-blocked\/\" target=\"_blank\" rel=\"noreferrer noopener\">&nbsp;judge said recently<\/a>, because it targets \u201cviewpoints the government wishes to punish and, apparently, attempt to extinguish.\u201d<\/p>\n\n\n\n<p>Another&nbsp;<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/ending-radical-indoctrination-in-k-12-schooling\/\" target=\"_blank\" rel=\"noreferrer noopener\">Trump directive<\/a>, forbidding schools nationwide from teaching about \u201cgender ideology\u201d or \u201cdiscriminatory equity ideology,\u201d is&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/education\/2025\/01\/29\/trump-education-orders-indoctrination-school-choice-antisemitism\/\" target=\"_blank\" rel=\"noreferrer noopener\">drawing similar criticism<\/a>&nbsp;from free-speech advocates, who say the president has no authority to punish local school districts for teaching ideas he rejects.<\/p>\n\n\n\n<p>The White House is also punishing the Associated Press, a major news organization, for continuing to call the Gulf of Mexico by its long-standing name rather than switching to \u201cGulf of America,\u201d as Trump has dictated. In a&nbsp;<a href=\"https:\/\/www.ap.org\/wp-content\/uploads\/2025\/02\/AP-v.-Budowich-Complaint.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a>&nbsp;protesting its ban from White House events, the AP noted that \u201cthe Constitution does not allow the government to control speech.\u201d<\/p>\n\n\n\n<p>Taken together, many free-speech advocates said, the actions amount to a heavy-handed and likely illegal effort to control the national conversation. But a senior White House official took strong issue with that characterization.<\/p>\n\n\n\n<p>\u201cPresident Trump is the most transparent president in American history,\u201d said principal deputy press secretary Harrison Fields. \u201cHe is a defender of the First Amendment. Any suggestion otherwise is laughable.\u201d<\/p>\n\n\n\n<p>It was President Joe Biden, Fields said, who pressured social media companies to remove posts related to covid-19, saying they were dangerous misinformation. \u201cCompared to his predecessor, who forced private industry to censor content, President Trump will ensure the free flow of ideas to continue,\u201d he said.<\/p>\n\n\n\n<p>Trump\u2019s assault on progressive speech has been largely, though not exclusively, in the service of beating back what he and his supporters depict as a \u201cwoke\u201d leftism that proclaims America a racist country and gender a social construct.<\/p>\n\n\n\n<p>In many ways, this is the latest \u2014 and perhaps most ferocious \u2014 chapter in a long-running cultural battle. Conservatives have complained for years that liberals bully and vilify them if they depart from progressive orthodoxy. Progressives say it is Republicans who are mounting a sweeping assault on free speech, seeking to punish those who dare to raise America\u2019s troubled racial past or explore the complex subject of gender identity.<\/p>\n\n\n\n<p>Trump has charged aggressively into this volatile terrain.<\/p>\n\n\n\n<p>The&nbsp;<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mdd.575287\/gov.uscourts.mdd.575287.44.0_2.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">sternest rebuke<\/a>&nbsp;to his approach so far may have come from U.S. District Judge Adam Abelson, who on Feb. 21 largely suspended Trump\u2019s orders targeting DEI programs. The judge said a requirement that anyone receiving federal grants or contracts must certify that they do not promote DEI \u201con its face\u201d violates freedom of speech.<\/p>\n\n\n\n<p>Another part of the orders, threatening action against companies that promote DEI, is also \u201cfacially unconstitutional,\u201d the judge said. Noting that the administration had not issued similar warnings to those who oppose DEI, he added, \u201cThat is textbook viewpoint-based discrimination.\u201d<\/p>\n\n\n\n<p>The administration has appealed the ruling. \u201cThe administration feels that every order that they have signed is legal and within its Article II powers, and we feel the Supreme Court will have the final say in our favor if it goes that far,\u201d the senior official said.<\/p>\n\n\n\n<figure class=\"wp-block-image alignwide size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"768\" height=\"512\" src=\"https:\/\/tingchao.xyz\/wp-content\/uploads\/2025\/03\/2-1.webp\" alt=\"\" class=\"wp-image-9974\" srcset=\"https:\/\/tingchao.xyz\/wp-content\/uploads\/2025\/03\/2-1.webp 768w, https:\/\/tingchao.xyz\/wp-content\/uploads\/2025\/03\/2-1-300x200.webp 300w\" sizes=\"auto, (max-width: 768px) 100vw, 768px\" \/><figcaption class=\"wp-element-caption\">Dozens of AIDS activists and protesters are arrested in the Rotunda of the Cannon House Office Building on Capitol Hill on Wednesday.\u00a9\u00a0Demetrius Freeman\/The Washington Post<\/figcaption><\/figure>\n\n\n\n<p>Critics cite other examples of what they call a reckless approach to free speech.<\/p>\n\n\n\n<p>Brendan Carr, chairman of the Federal Communications Commission, has warned Comcast Corp. that a statement on its website saying \u201cdiversity, equity and inclusion are a core value of our business\u201d might violate federal regulations, for example.<\/p>\n\n\n\n<p>Veterans Affairs Secretary Douglas A. Collins has&nbsp;<a href=\"https:\/\/department.va.gov\/public-display-or-depiction-of-flags-throughout-va\/\" target=\"_blank\" rel=\"noreferrer noopener\">banned the display<\/a>&nbsp;of gay pride and similar flags in employees\u2019 private offices and cubicles. Collins said the new guidelines would bring \u201cconsistency and simplicity to the display of flags,\u201d but some employees complain that the administration is going out of its way to target their personal identity and expression.<\/p>\n\n\n\n<p>Outside the government, universities, companies and nonprofits around the country are rapidly removing statements that support DEI for fear of provoking the administration\u2019s wrath. In the view of many free-speech experts, that is a classic \u201cchilling effect\u201d prompted by a government threat, even if the courts may eventually overturn some of Trump\u2019s actions.<\/p>\n\n\n\n<p>\u201cThe law moves more slowly than what is happening right now,\u201d Deutchman said. \u201cEven during the time when it is getting challenged in court and gets a preliminary injunction, some of the damage is already happening. It\u2019s beyond a chilling effect \u2014 it\u2019s more like a freeze.\u201d<\/p>\n\n\n\n<p>Hawaii Gov. Josh Green, a Democrat, took particular issue with the administration\u2019s efforts to cull words like \u201cgender\u201d and \u201cinclusion\u201d from public documents.<\/p>\n\n\n\n<p>\u201cAll words should be usable, and then we should have a strong debate,\u201d Green said. \u201cI find that to be the more punitive part of what we saw from the election \u2026 I think that that\u2019s the red meat that president is throwing to the base.\u201d<\/p>\n\n\n\n<p>Green, a physician, said words like \u201cgender\u201d and \u201ctransgender\u201d are medical terms that are crucial for researchers studying health disparities. \u201cThese are the kind of words that are being plucked from the lexicon, and that is not helpful,\u201d he said.<\/p>\n\n\n\n<p>In some cases, the administration\u2019s actions seem more personal.<\/p>\n\n\n\n<p>Edward Martin, Trump\u2019s interim U.S. attorney for the District of Columbia, challenged Rep. Robert Garcia (D-California) after&nbsp;<a href=\"https:\/\/x.com\/brikeilarcnn\/status\/1889792047411823044?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1889792047411823044%7Ctwgr%5Ef4db38bfdf3383e3f68b2b2a0b56edb7dd9e150a%7Ctwcon%5Es1_&amp;ref_url=https%3A%2F%2Fathena.huffpost.net%2Fus%2Fcms%2Fentry%2F67ad13b0e4b0232270789c7e\" target=\"_blank\" rel=\"noreferrer noopener\">Garcia told CNN<\/a>&nbsp;that Democrats should forcefully oppose Trump and Musk. \u201cWhat the American public wants is for us to bring actual weapons to this bar fight,\u201d Garcia said. \u201cThis is an actual fight for democracy.\u201d<\/p>\n\n\n\n<p>Martin, the chief federal prosecutor in Washington,&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/dc-md-va\/2025\/02\/19\/trump-justice-operation-whirlwind-democrats\/\" target=\"_blank\" rel=\"noreferrer noopener\">fired off a letter<\/a>&nbsp;to Garcia demanding that the congressman \u201cclarify\u201d his remarks. \u201cThis sounds to some like a threat to Mr. Musk,\u201d Martin wrote. \u201cWe take threats against public officials very seriously.\u201d<\/p>\n\n\n\n<p>Garcia said that was a pretext to go after speech critical of the administration. \u201cI will not be silenced,\u201d he posted on X.<\/p>\n\n\n\n<figure class=\"wp-block-image alignwide size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"768\" height=\"512\" src=\"https:\/\/tingchao.xyz\/wp-content\/uploads\/2025\/03\/3-1.webp\" alt=\"\" class=\"wp-image-9975\" srcset=\"https:\/\/tingchao.xyz\/wp-content\/uploads\/2025\/03\/3-1.webp 768w, https:\/\/tingchao.xyz\/wp-content\/uploads\/2025\/03\/3-1-300x200.webp 300w\" sizes=\"auto, (max-width: 768px) 100vw, 768px\" \/><figcaption class=\"wp-element-caption\">Elon Musk speaks with President Donald Trump and reporters in the Oval Office on Tuesday.\u00a9\u00a0Jabin Botsford\/The Washington Post<\/figcaption><\/figure>\n\n\n\n<p>Trump and his aides see the landscape through a very different prism, insisting they are not imposing speech restrictions but dissolving them.<\/p>\n\n\n\n<p>Within hours of taking office, Trump issued an&nbsp;<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/restoring-freedom-of-speech-and-ending-federal-censorship\/\" target=\"_blank\" rel=\"noreferrer noopener\">executive order<\/a>&nbsp;titled \u201cRestoring freedom of speech and ending federal censorship.\u201d Some free-speech advocates welcomed the order, which broadly directed federal agencies not to trample on free expression.<\/p>\n\n\n\n<p>Rick Hess, a senior fellow at the conservative American Enterprise Institute, agreed that some of the concerns about Trump\u2019s actions are valid. But he said Biden also threatened private speech when he was in office, for example, with an executive order promoting DEI.<\/p>\n\n\n\n<p>\u201cThere is a game of one-upmanship,\u201d Hess said. \u201cYou did not hear the same voices raising the same concerns when President Biden did his whole-of-government equity order, which for many on the right raised similar concerns.\u201d<\/p>\n\n\n\n<p>In recent years, he added, some colleges have required job applicants to submit statements attesting to their commitment to DEI.<\/p>\n\n\n\n<p>\u201cContext is important,\u201d Hess said of Trump\u2019s actions. \u201cIt\u2019s not like there were only wonderful, healthy First Amendment precedents, then this. This is part of a pattern.\u201d<\/p>\n\n\n\n<p>Yet Trump and his allies have gone after news organizations, using tactics that are unprecedented in recent memory.<\/p>\n\n\n\n<p>After Trump proclaimed that the Gulf of Mexico should be called the \u201cGulf of America,\u201d the Associated Press \u2014 noting that the body of water also borders Mexico and Cuba \u2014 decided to stick with the name that had been in use for more than 400 years.<\/p>\n\n\n\n<p>The White House said the AP was \u201clying\u201d by using that name and banned the news organization from spaces like the Oval Office and Air Force One, which are critical for covering the president. The AP has sued, saying \u201cthe press and all the people in the United States have the right to choose their own words and not be retaliated against by the government.\u201d<\/p>\n\n\n\n<p>The White House responded that getting to ask the president questions is a privilege, not a right. A judge has declined to order the AP\u2019s immediate reinstatement as the case unfolds.<\/p>\n\n\n\n<p>Even before he took office, Trump sued the Des Moines Register and its pollster, J. Ann Selzer, complaining that a pre-election poll that wrongly showed Vice President Kamala Harris leading in Iowa was a form of fraud. (Trump won Iowa 56-43 percent.)<\/p>\n\n\n\n<p>\u201cThe Harris Poll was no \u2018miss\u2019 but rather an attempt to influence the outcome of the 2024 Presidential Election,\u201d the suit claimed, without providing evidence. Selzer\u2019s lawyers called that assertion \u201ca transparent attempt to punish news coverage and analysis of a political campaign.\u201d<\/p>\n\n\n\n<p>Of potentially greater concern to free-press advocates, White House officials recently announced that they, not the White House press corps, would decide which reporters get access to the president through the press pool, a rotation for covering smaller events.<\/p>\n\n\n\n<figure class=\"wp-block-image alignwide size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"768\" height=\"512\" src=\"https:\/\/tingchao.xyz\/wp-content\/uploads\/2025\/03\/4.webp\" alt=\"\" class=\"wp-image-9976\" srcset=\"https:\/\/tingchao.xyz\/wp-content\/uploads\/2025\/03\/4.webp 768w, https:\/\/tingchao.xyz\/wp-content\/uploads\/2025\/03\/4-300x200.webp 300w\" sizes=\"auto, (max-width: 768px) 100vw, 768px\" \/><figcaption class=\"wp-element-caption\">Screens display \u201cVictory\u201d over a Gulf of America map in the Brady Briefing Room at the White House on Monday.\u00a9\u00a0Jabin Botsford\/The Washington Post<\/figcaption><\/figure>\n\n\n\n<p>Journalists from an array of outlets said the move would allow the White House to punish some organizations and reward others for their coverage. \u201cIn a free country, leaders must not be able to choose their own press corps,\u201d the White House Correspondents\u2019 Association said in a&nbsp;<a href=\"https:\/\/whca.press\/2025\/02\/25\/whca-statement-on-white-house-announcement-on-press-pool\/\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>.<\/p>\n\n\n\n<p>The senior administration official said the move was aimed at including more news organizations in the coverage. \u201cWe\u2019ve been very clear that the move to shake up the press briefing room is about allowing more access, not less, to the president in the more intimate parts of the White House,\u201d the official said. \u201cThis is about expanding access, not limiting access.\u201d<\/p>\n\n\n\n<p>Carolyn Iodice, legislative and policy director of the Foundation for Individual Rights and Expression, said people in power often want to control the conversation in ways the U.S. Constitution forbids.<\/p>\n\n\n\n<p>\u201cIt\u2019s always a struggle. Free speech is about power, and those who have power are often interested in retaining it,\u201d Iodice said. \u201cControlling speech is one way to do that.
