Until 1995,&nbsp;for example, gay people often had their security clearances&nbsp;<a href=\"https:\/\/www.cia.gov\/readingroom\/docs\/CIA-RDP90-00552R000202360014-5.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">removed<\/a>&nbsp;as officials claimed they could be subject to&nbsp;<a href=\"https:\/\/www.nytimes.com\/1995\/08\/05\/us\/clinton-ends-ban-on-security-clearance-for-gay-workers.html\" target=\"_blank\" rel=\"noreferrer noopener\">blackmail<\/a>. During the Vietnam War, officials or contractors perceived to be opponents of the war had their clearances canceled, said Meyer,&nbsp;a&nbsp;partner&nbsp;at the law firm Tully Rinckey.<\/p>\n\n\n\n<p>But no president has ever waded directly into the clearance process so publicly and on such a large scale as Trump did when he rescinded security clearances for&nbsp;50 people in one step,&nbsp;Meyer and other legal experts said.&nbsp;Nor has a commander in chief chosen to publicly rescind security clearances for former CIA directors, deputy directors and other former top-ranking intelligence officials, many of whom worked for administrations from both parties.<\/p>\n\n\n\n<p>In an executive order issued hours&nbsp;after his inauguration on Monday,&nbsp;Trump stripped 49 former senior officials of&nbsp;their&nbsp;security clearances for signing a letter more than four years ago that Trump said showed \u201cmisleading and inappropriate political coordination\u201d with Joe Biden\u2019s 2020 presidential campaign.<\/p>\n\n\n\n<p>The former senior officials have repeatedly denied Trump&#8217;s claim. The 2020 open letter, endorsed by former senior intelligence and national security officials, suggested Russia might have played a role in spreading allegations about Biden\u2019s son Hunter as part of a wider effort to influence the outcome of the election.<\/p>\n\n\n\n<p>Trump&nbsp;also removed the security clearance for John Bolton, his former national security adviser, accusing him of revealing sensitive information in a memoir. Bolton has denied revealing any information that jeopardized national security.<\/p>\n\n\n\n<p>The former intelligence officials say that Trump\u2019s mass scrapping of clearances is an attempt to punish, intimidate and silence those who challenge his claims.&nbsp;<\/p>\n\n\n\n<p>Trump is&nbsp;\u201ctrying to censor the public statements of former government officials,\u201d said a former senior intelligence official who signed the letter and spoke on condition of anonymity,&nbsp;citing fears of retaliation. \u201cNone of us were working in government at the time. We were private citizens.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-image alignwide size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"768\" height=\"512\" src=\"https:\/\/tingchao.xyz\/wp-content\/uploads\/2025\/01\/2-13.jpg\" alt=\"\" class=\"wp-image-9410\" srcset=\"https:\/\/tingchao.xyz\/wp-content\/uploads\/2025\/01\/2-13.jpg 768w, https:\/\/tingchao.xyz\/wp-content\/uploads\/2025\/01\/2-13-300x200.jpg 300w\" sizes=\"auto, (max-width: 768px) 100vw, 768px\" \/><figcaption class=\"wp-element-caption\">John Bolton listens to Donald Trump at the White House on July 18, 2019.\u00a9\u00a0Chip Somodevilla<\/figcaption><\/figure>\n\n\n\n<p>A White House spokesperson rejected the criticism and said the executive order&nbsp;would restore the&nbsp;credibility of&nbsp;government institutions.<\/p>\n\n\n\n<p>\u201cBy abusing their previous positions in government, these individuals helped sell a public relations fraud to the American people,\u201d Brian Hughes, a spokesperson for the White House National Security Council, said in an email. \u201cThey greatly damaged the credibility of the Intelligence Community by using their privileges to interfere in a presidential election. President Trump\u2019s action is restoring the credibility of our nation\u2019s institutions.\u201d&nbsp;<\/p>\n\n\n\n<p>Trump\u2019s order also raised the possibility of additional punitive action related to the 2020 letter. The executive order requires the director of national intelligence to examine whether anyone else who held a security clearance engaged in \u201cinappropriate activity\u201d related to the letter and to submit a report on their findings within 90 days.<\/p>\n\n\n\n<p>Kevin Carroll, a lawyer representing one of the letter&#8217;s signatories, said the former officials&nbsp;were simply using their right&nbsp;as private citizens to express their opinion. He said&nbsp;their public statements should have no bearing on their security clearances.<\/p>\n\n\n\n<p>\u201cRetired intelligence officials maintain just as much of a right to offer unclassified opinions, correct or incorrect, on public matters as do retired diplomats, military officers, prosecutors \u2014 or politicians for the matter,\u201d Carroll said. \u201cIt is wrong to revoke their clearances simply for doing so.\u201d<\/p>\n\n\n\n<p>Carroll added that&nbsp;the federal guidelines for granting access to classified information provide no grounds for revoking a security clearance because of opinions expressed publicly.<\/p>\n\n\n\n<p>Former officials targeted by&nbsp;Trump\u2019s executive order also noted that other retired officials or military officers often express pro-Trump political opinions during recent campaigns but not been punished.<\/p>\n\n\n\n<p>In the 2020 campaign, more than 200 retired military officers&nbsp;<a href=\"https:\/\/www.military.com\/daily-news\/2020\/09\/15\/dozens-of-retired-generals-admirals-sign-letter-backing-trump-reelection.html\" target=\"_blank\" rel=\"noreferrer noopener\">endorsed<\/a>&nbsp;Trump in an open letter, saying they feared that alleged \u201csocialists and Marxists\u201d in the Democratic Party posed a threat to the country\u2019s way of life.&nbsp;None of their security clearances were revoked.<\/p>\n\n\n\n<p>Mark Zaid, a lawyer representing multiple signatories of the letter, said he believed many of the former officials no longer had active security clearances. The action therefore carried little concrete effect&nbsp;and amounted to a political move, Zaid said.<\/p>\n\n\n\n<p>\u201cIt was clearly meant to bolster his ideological base and to show that he\u2019s doing what they want,\u201d Zaid said.<\/p>\n\n\n\n<p>It remains unclear if the 50 former officials affected will take legal action to challenge Trump&#8217;s executive order. In cases&nbsp;where&nbsp;security clearance decisions or procedures have been appealed, rulings tend to favor the executive branch, which retains expansive authority over determining who should have access to classified material.<\/p>\n\n\n\n<p>Former CIA directors and deputy directors are traditionally given security clearances during their retirement to allow their successors to consult them on issues that came up.<\/p>\n\n\n\n<p>But Trump has long harbored distrust of the country\u2019s intelligence and national security agencies, dating back to the 2016 election campaign. At that time, the FBI launched a counterintelligence investigation into possible links between Trump campaign associates and the Russian government.&nbsp;And&nbsp;U.S. spy agencies assessed that the Kremlin sought to covertly tip the election to Trump through information warfare.<\/p>\n\n\n\n<p>Trump accused the intelligence agencies of plotting to undermine his first term, part of what he and his supporters call a \u201cdeep state\u201d conspiracy.&nbsp;Throughout the 2024 election campaign, Trump vowed to overhaul the intelligence community and the Justice Department.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>A disputed letter<\/strong><\/h2>\n\n\n\n<p>Titled \u201cHolding Former Government Officials Accountable for Election Interference and Improper Disclosure of Sensitive Governmental Information,\u201d the president\u2019s order refers to the open letter signed by 51 former senior intelligence and national security officials in October 2020. (Two of the signatories are now deceased.)<\/p>\n\n\n\n<p>The letter, which was sent to news outlets, addressed&nbsp;<a href=\"https:\/\/nypost.com\/2020\/10\/14\/email-reveals-how-hunter-biden-introduced-ukrainian-biz-man-to-dad\/\" target=\"_blank\" rel=\"noreferrer noopener\">a report in the New York Post<\/a>&nbsp;that cited emails the paper said came from a laptop belonging to Hunter Biden. The Post said it had obtained the hard drive of the laptop from Trump\u2019s lawyer and ally Rudy Giuliani and reported on emails related to Hunter Biden\u2019s consulting activities in Ukraine.<\/p>\n\n\n\n<p>The emergence of the emails \u201chas all the classic earmarks of a Russian information operation,\u201d the letter from the former officials stated.<\/p>\n\n\n\n<p>\u201cWe want to emphasize that we do not know if the emails, provided to the New York Post by President Trump\u2019s personal attorney, Rudy Giuliani, are genuine or not,\u201d&nbsp;it said,&nbsp;\u201cand that we do not have evidence of Russian involvement \u2014 just that our experience makes us deeply suspicious that the Russian government played a significant role in this case.\u201d<\/p>\n\n\n\n<p>\u201cIf we are right, this is Russia trying to influence how Americans vote in this election, and we&nbsp;believe strongly that Americans need to be aware of this,\u201d the letter said.<\/p>\n\n\n\n<p>Carroll said the former officials\u2019 suspicions were reasonable given \u201cdocumented Russian interference in the 2016 U.S. presidential election.\u201d<\/p>\n\n\n\n<p>For Trump and his allies, however, the letter was&nbsp;seen as an&nbsp;attempt by former officials using their association with U.S. intelligence agencies to suppress damaging information about the Biden family weeks before the 2020 election. They labeled the&nbsp;letter\u2019s signatories,&nbsp;who included many supporters of Biden\u2019s candidacy, \u201c<a href=\"https:\/\/nypost.com\/2022\/03\/18\/intelligence-experts-refuse-to-apologize-for-smearing-hunter-biden-story\/\" target=\"_blank\" rel=\"noreferrer noopener\">spies who lie<\/a>.\u201d<\/p>\n\n\n\n<p>\u201cThe signatories willfully weaponized the gravitas of the Intelligence Community to manipulate the political process and undermine our democratic institutions,\u201d Trump\u2019s executive order stated.<\/p>\n\n\n\n<p>Material found on the hard drive of the laptop was later verified, and it became evidence in a&nbsp;Justice Department&nbsp;criminal investigation of Hunter Biden. Prosecutors did not accuse Hunter Biden of corrupt dealings in Ukraine but he was&nbsp;convicted on federal gun charges and pled guilty to tax evasion&nbsp;last year.<\/p>\n\n\n\n<p>Career officials in the intelligence agencies see themselves as nonpartisan professionals dedicated to helping inform the president\u2019s decision-making regarding threats facing the country. But Trump\u2019s executive order shows how a hyperpartisan political landscape can cause a president to not trust&nbsp;career intelligence officials who have served administrations from both parties.<\/p>\n\n\n\n<figure class=\"wp-block-image alignwide size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"768\" height=\"512\" src=\"https:\/\/tingchao.xyz\/wp-content\/uploads\/2025\/01\/3-10.jpg\" alt=\"\" class=\"wp-image-9411\" srcset=\"https:\/\/tingchao.xyz\/wp-content\/uploads\/2025\/01\/3-10.jpg 768w, https:\/\/tingchao.xyz\/wp-content\/uploads\/2025\/01\/3-10-300x200.jpg 300w\" sizes=\"auto, (max-width: 768px) 100vw, 768px\" \/><figcaption class=\"wp-element-caption\">The seal of Central Intelligence Agency in the lobby the headquarters building in Langley, Va., on Sept. 24, 2022.\u00a9\u00a0Provided by NBC News<\/figcaption><\/figure>\n\n\n\n<p>Trump has \u201cexcluded the core leadership from the old Republican and current Democratic circles of trust,\u201d Meyer said. \u201cThis is about information, and controlling who is in the conversation.\u201d<\/p>\n\n\n\n<p>Other presidents have chosen not to exercise their authority over security clearances in such a public, partisan manner, one of the former officials who signed the 2020 letter said. Trump\u2019s action demonstrates how he ignores unwritten norms and rules that have largely governed the conduct of his predecessors.<\/p>\n\n\n\n<p>\u201cOur democratic system is dependent, at the end of the day, on goodwill and people trying to do the right thing, and there being moral opprobrium attached to not doing the right thing,\u201d the ex-official said. \u201cAnd that has fallen away.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Bolton\u2019s memoir<\/strong><\/h2>\n\n\n\n<p>In the executive order, Trump said his decision to revoke the clearance for John Bolton, who served as his national security adviser during his first term, was in response to Bolton\u2019s memoir, \u201cThe Room Where It Happened.\u201d<\/p>\n\n\n\n<p>In the book, Bolton described Trump as \u201cstunningly uninformed\u201d on foreign policy and&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/outlook\/john-boltons-book-is-full-of-startling-revelations-he-should-have-told-us-sooner\/2020\/06\/17\/beac5bb6-b0e5-11ea-8758-bfd1\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>: \u201cI am hard-pressed to identify any significant Trump decision during my tenure that wasn\u2019t driven by re-election calculations.\u201d<\/p>\n\n\n\n<p>But Trump\u2019s executive order said, \u201cThe memoir\u2019s reckless treatment of sensitive information undermined the ability of future presidents to request and obtain candid advice on matters of national security from their staff.\u201d<\/p>\n\n\n\n<p>Bolton&nbsp;and former Justice Department officials have said the book revealed no classified information and that he handled the matter appropriately and lawfully.&nbsp;And a judge&nbsp;<a href=\"https:\/\/www.nytimes.com\/2020\/09\/15\/us\/politics\/john-bolton-book-criminal-investigation.html\" target=\"_blank\" rel=\"noreferrer noopener\">rejected<\/a>&nbsp;allegations that Bolton pressed ahead with publication without the completion of a government review to remove possible classified information.<\/p>\n\n\n\n<p>Trump&nbsp;this week also canceled Secret Service protection for Bolton. The security detail was provided to Bolton because of an alleged assassination plot that was part of Tehran\u2019s bid to retaliate against&nbsp;Trump for his approval of&nbsp;the 2020 U.S. drone strike that killed top Iranian Gen.
