{"id":7971,"date":"2024-10-17T09:25:19","date_gmt":"2024-10-17T01:25:19","guid":{"rendered":"https:\/\/tingchao.xyz\/?p=7971"},"modified":"2024-10-17T09:25:23","modified_gmt":"2024-10-17T01:25:23","slug":"judge-rejects-handful-of-controversial-rules-including-hand-count-rule-from-georgia-board","status":"publish","type":"post","link":"https:\/\/tingchao.xyz\/?p=7971","title":{"rendered":"Judge rejects handful of controversial rules, including hand-count rule, from Georgia board"},"content":{"rendered":"\n<figure class=\"wp-block-image alignwide size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"798\" height=\"455\" src=\"https:\/\/tingchao.xyz\/wp-content\/uploads\/2024\/10\/4-1.png\" alt=\"\" class=\"wp-image-7972\" srcset=\"https:\/\/tingchao.xyz\/wp-content\/uploads\/2024\/10\/4-1.png 798w, https:\/\/tingchao.xyz\/wp-content\/uploads\/2024\/10\/4-1-300x171.png 300w, https:\/\/tingchao.xyz\/wp-content\/uploads\/2024\/10\/4-1-768x438.png 768w\" sizes=\"auto, (max-width: 798px) 100vw, 798px\" \/><\/figure>\n\n\n\n<p>A judge in Georgia tossed out a handful of controversial rules passed in recent months by the GOP-majority Georgia State Election Board, arguing that the board didn\u2019t have the authority to put those rules into effect.<\/p>\n\n\n\n<p>Fulton County Superior Court Judge Thomas Cox Jr. ordered seven rules that were passed by the board \u2014 some of which include requiring ballots to be hand-counted by precinct, allowing a \u201creasonable inquiry\u201d to be undertaken by election workers ahead of certification and another where \u201call election related documentation created during the conduct of elections\u201d could be examined by election officials \u2014 to be rejected ahead of November.<\/p>\n\n\n\n<p>Cox argued in his ruling that the election board \u201chas no constitutional authority to promulgate these rules because the General Assembly did not provide \u2018sufficient\u2019 or \u2018realistic\u2019 parameters around the [board\u2019s] rulemaking here,\u201d and \u201cthe U.S. Constitution prohibits the [board] from enacting election rules regarding the election of federal officers.\u201d<\/p>\n\n\n\n<p>The Georgia State Election Board has been under increasing scrutiny for passing controversial rules several months ahead of the election. Even some of the state\u2019s top Republicans and their offices have expressed concern over some of the rulemaking, particularly the hand-count law.<\/p>\n\n\n\n<p>The rules and Cox\u2019s recent decision are all the more important given that Georgia is among a handful of battleground states that will determine whether former President Trump or Vice President Harris will return to the White House.<\/p>\n\n\n\n<p>Trump won the Peach State in 2016 but narrowly lost it to President Biden in 2020.
