But \u2014 er, snag \u2014 we got yet another delay in the D.C. election interference case, which has had the most momentum of the four criminal cases against Trump this sleepy August.<\/p>\n\n\n\n<p>We\u2019ll explain that delay and some new filings that landed in the other cases in this week\u2019s edition of the Trump Trials newsletter.<\/p>\n\n\n\n<p><em>(Have questions on Trump\u2019s trials? Email us at&nbsp;<\/em><a href=\"mailto:perry.stein@washpost.com\" target=\"_blank\" rel=\"noreferrer noopener\"><em>perry.stein@washpost.com<\/em><\/a><em>&nbsp;and&nbsp;<\/em><a href=\"mailto:devlin.barrett@washpost.com\" target=\"_blank\" rel=\"noreferrer noopener\"><em>devlin.barrett@washpost.com<\/em><\/a><em>&nbsp;and check for answers in future newsletters.)<\/em><\/p>\n\n\n\n<p>Okay, let\u2019s get started.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What\u2019s ahead<\/h3>\n\n\n\n<p>We thought&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/national-security\/2024\/08\/02\/trump-election-subversion-immunity\/\" target=\"_blank\" rel=\"noreferrer noopener\">we\u2019d have a hearing this Friday&nbsp;<\/a>in the D.C. election interference case \u2014 the first at the trial court level in months. But that\u2019s now been delayed. (We\u2019ll explain more below.)<\/p>\n\n\n\n<p>In the Big Apple, Trump is still trying to remove New York Supreme Court Justice Juan Merchan from the case. It\u2019s a long shot request, but Merchan&nbsp;<a href=\"https:\/\/www.nycourts.gov\/LegacyPDFS\/press\/pdfs\/8-5-24Letter-to-Parties.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">said he would rule<\/a>&nbsp;on the recusal motion this week.<\/p>\n\n\n\n<p>The appeals process in the Florida classified document case will start at the end of the month.<\/p>\n\n\n\n<p>Now, a recap of last week\u2019s action.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">1. D.C.: Federal case on 2020 election<\/h3>\n\n\n\n<p><strong>The details:<\/strong>&nbsp;Four counts related to conspiring to obstruct&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/national-security\/2023\/08\/01\/trump-indicted-jan-6-overturn-2020-election-results\/\" target=\"_blank\" rel=\"noreferrer noopener\">the 2020 election results<\/a>.<\/p>\n\n\n\n<p><strong>Why it\u2019s stalled:<\/strong>&nbsp;The trial has been delayed while the Supreme Court answered the question of whether presidential immunity from criminal prosecution extended to Trump\u2019s alleged crimes in trying to block Joe Biden\u2019s election victory. The Supreme Court last month significantly narrowed the parameters for when a president can be prosecuted and said lower courts should get the first shot at deciding what that means for this case.<\/p>\n\n\n\n<p><strong>Last week:\u00a0<\/strong>U.S. District Judge Tanya S. Chutkan had set an Aug. 9 deadline for both sides to provide her with a proposed schedule on how they should proceed. A subsequent hearing was set for Aug. 16.<\/p>\n\n\n\n<p>But the special counsel asked for a three-week delay, saying his office needed more time to assess the Supreme Court\u2019s immunity decision and had not yet \u201cfinalized its position\u201d on a schedule. Trump\u2019s attorneys didn\u2019t object to the request&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/dc-md-va\/2024\/08\/08\/special-counsel-trump-case-delay-jan-6-dc\/\" target=\"_blank\" rel=\"noreferrer noopener\">and Chutkan granted it<\/a>. The sides now have until Aug. 30 to brief the court, with a hearing scheduled for Sept. 5.<\/p>\n\n\n\n<p>It\u2019s not surprising that special counsel Jack Smith isn\u2019t barreling ahead \u2014 and that Chutkan granted the later deadlines. There\u2019s little chance that this case is going to trial this year, so Smith is no longer racing against the Inauguration Day clock. Plus, the Supreme Court chided the lower courts in its presidential immunity opinion for moving so fast with this case, so everyone is moving a little more gingerly.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Nerd word of the week<\/h3>\n\n\n\n<p><em>Unopposed motion<\/em>: Judges generally want parties to discuss with each other their requests before they formally lodge them with the court. The hope is that the parties come to a resolution on their own without a judge\u2019s involvement.<\/p>\n\n\n\n<p>In D.C., the special counsel filed an&nbsp;<em>unopposed motion<\/em>&nbsp;to extend the briefing and hearing deadline by three weeks. Smith wrote in his unopposed motion that he conferred with Trump\u2019s attorneys about the later deadlines and they did not oppose the delay. Since the two sides agreed, Chutkan quickly ruled in favor of the new schedule.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. New York: State hush money case<\/h3>\n\n\n\n<p><strong>The details:<\/strong>&nbsp;34 charges&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/national-security\/2023\/03\/30\/trump-ny-indictment\/?itid=lk_inline_manual_18&amp;itid=lk_inline_manual_54\" target=\"_blank\" rel=\"noreferrer noopener\">connected to a 2016 hush money payment<\/a>.<\/p>\n\n\n\n<p><strong>Why it\u2019s stalled:&nbsp;<\/strong>A jury&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/politics\/2024\/05\/30\/trump-guilty-verdict-hush-money-trial\/\" target=\"_blank\" rel=\"noreferrer noopener\">found Trump guilty<\/a>&nbsp;on May 30. Sentencing was scheduled for July 11 but was&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/politics\/2024\/07\/02\/trump-sentencing-delay-supreme-court-ruling\/\" target=\"_blank\" rel=\"noreferrer noopener\">delayed until mid-September<\/a>&nbsp;so the judge can consider Trump\u2019s request to toss out the verdict based on the Supreme Court\u2019s presidential immunity ruling.<\/p>\n\n\n\n<p><strong>Last week:&nbsp;<\/strong>Merchan had said he would decide by Sept. 6 whether the verdict should be overturned. Merchan&nbsp;<a href=\"https:\/\/www.nycourts.gov\/LegacyPDFS\/press\/pdfs\/8-5-24Letter-to-Parties.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">wrote in a letter last week<\/a>&nbsp;that the key ruling will now arrive on Sept. 16. The judge said Trump\u2019s sentencing hearing isn\u2019t changing and \u2014 if the verdict stands \u2014 is still scheduled for Sept. 18.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. Florida: Federal classified documents case<\/h3>\n\n\n\n<p><strong>The details:&nbsp;<\/strong>Trump used to face 40 federal charges&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/national-security\/2023\/07\/27\/trump-carlos-deoliveira-classified-indictment\/?itid=lk_inline_manual_16&amp;itid=lk_inline_manual_38\" target=\"_blank\" rel=\"noreferrer noopener\">over accusations that he kept top-secret government documents<\/a>&nbsp;at Mar-a-Lago \u2014 his home and private club \u2014 and thwarted government demands to return them.<\/p>\n\n\n\n<p><strong>Why it\u2019s stalled:<\/strong>&nbsp;U.S. District Judge Aileen M. Cannon&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/national-security\/2024\/07\/15\/trump-classified-trial-dismisssed-cannon\/\" target=\"_blank\" rel=\"noreferrer noopener\">dismissed the entire case<\/a>&nbsp;on July 15, saying Smith was improperly appointed as special counsel and had no authority to bring the indictment. Smith has vowed to appeal the decision.<\/p>\n\n\n\n<p>This case, too, could reach the Supreme Court. If Smith wins, the trial could be resurrected \u2014 although it would be hard for the case to survive if Trump again becomes president.<\/p>\n\n\n\n<p><strong>Last week:&nbsp;<\/strong>Nothing is happening in this case until Smith files his appeal, which is due by Aug. 27 at the U.S. Court of Appeals for the 11th Circuit in Atlanta.<\/p>\n\n\n\n<figure class=\"wp-block-image alignwide size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"768\" height=\"512\" src=\"https:\/\/tingchao.xyz\/wp-content\/uploads\/2024\/08\/2-5.jpg\" alt=\"\" class=\"wp-image-7083\" srcset=\"https:\/\/tingchao.xyz\/wp-content\/uploads\/2024\/08\/2-5.jpg 768w, https:\/\/tingchao.xyz\/wp-content\/uploads\/2024\/08\/2-5-300x200.jpg 300w\" sizes=\"auto, (max-width: 768px) 100vw, 768px\" \/><figcaption class=\"wp-element-caption\">Fulton County District Attorney Fani T. Georgia: State case on 2020 election<\/h3>\n\n\n\n<p><strong>The details:&nbsp;<\/strong>Trump faces 10 state charges for allegedly trying to&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/national-security\/2023\/08\/14\/trump-indictment-georgia-election-2020\/\" target=\"_blank\" rel=\"noreferrer noopener\">undo the election results<\/a>&nbsp;in that state. Four of his 18 co-defendants have pleaded guilty.<\/p>\n\n\n\n<p><strong>Why it\u2019s stalled:&nbsp;<\/strong>The case is on pause while the Georgia Court of Appeals&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/national-security\/2024\/06\/12\/fani-willis-trump-appeal\/\" target=\"_blank\" rel=\"noreferrer noopener\">hears an appeal from Trump<\/a>&nbsp;and some of his co-defendants seeking to disqualify Fulton County District Attorney Fani T. Willis, the top prosecutor. The defendants argue that Willis improperly spent taxpayer dollars while in a romantic relationship with an attorney she hired to work on the case. That attorney has resigned from his position.<\/p>\n\n\n\n<p><strong>Last week:&nbsp;<\/strong>Willis\u2019s team responded to Trump\u2019s appeal, arguing that the lower court\u2019s opinion should stand. The prosecutors said there is no evidence that Willis violated the defendants\u2019 rights or had any financial conflict of interest.<\/p>\n\n\n\n<p>\u201cThey ask this Court to second guess the trial court\u2019s factual conclusions and apply standards of disqualification that no Georgia court has ever authorized or employed,\u201d the prosecutors wrote.<\/p>\n\n\n\n<p>Oral arguments for the appeal are set for Dec. 5.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Question Time<\/h3>\n\n\n\n<p><strong>Q.&nbsp;<\/strong><em>If Trump is elected in November, can his cases still go to trial after Election Day but before Inauguration Day in January?<\/em><\/p>\n\n\n\n<p><strong>A.&nbsp;<\/strong>Absolutely. Long-standing Justice Department policy says that officials cannot criminally charge a sitting president. But there\u2019s no policy that says officials cannot prosecute a president-elect who is not yet in office.<\/p>\n\n\n\n<p>We&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/national-security\/2024\/07\/02\/justice-dept-trump-prosecute-after-election\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported last month that<\/a>&nbsp;Justice Department officials plan to pursue the two federal cases against Trump past Election Day \u2014 even if he wins.<\/p>\n\n\n\n<p>Both of the federal trials have been tied up in the appeals courts, and it\u2019s looking like neither of them stand much of a chance of making it to trial before inauguration. But the appeals process can play out until Inauguration Day and beyond.<\/p>\n\n\n\n<p>If Trump is elected, it will be up to his Justice Department to decide whether it wants to continue pursuing any appeals. It\u2019s doubtful that a second Trump administration would argue against Trump\u2019s defense attorneys.<\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>We were ready to have real movement in one of the cases against Donald Trump this week.
