{"id":17863,"date":"2026-10-14T16:24:33","date_gmt":"2026-10-14T08:24:33","guid":{"rendered":"https:\/\/tingchao.xyz\/?p=17863"},"modified":"2026-10-14T16:24:43","modified_gmt":"2026-10-14T08:24:43","slug":"federal-judge-issues-longer-term-decision-blocking-trumps-white-house-media-ban","status":"publish","type":"post","link":"https:\/\/tingchao.xyz\/?p=17863","title":{"rendered":"Federal judge issues longer-term decision blocking Trump\u2019s White House media ban"},"content":{"rendered":"\n<figure class=\"wp-block-image alignwide size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/tingchao.xyz\/wp-content\/uploads\/2026\/10\/\u5c4f\u5e55\u622a\u56fe-2026-10-14-162246-1024x683.png\" alt=\"\" class=\"wp-image-17864\" srcset=\"https:\/\/tingchao.xyz\/wp-content\/uploads\/2026\/10\/\u5c4f\u5e55\u622a\u56fe-2026-10-14-162246-1024x683.png 1024w, https:\/\/tingchao.xyz\/wp-content\/uploads\/2026\/10\/\u5c4f\u5e55\u622a\u56fe-2026-10-14-162246-300x200.png 300w, https:\/\/tingchao.xyz\/wp-content\/uploads\/2026\/10\/\u5c4f\u5e55\u622a\u56fe-2026-10-14-162246-767x512.png 767w, https:\/\/tingchao.xyz\/wp-content\/uploads\/2026\/10\/\u5c4f\u5e55\u622a\u56fe-2026-10-14-162246.png 1187w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">A federal judge issued an order late Tuesday blocking the Trump administration from banning CNN, Politico and MS NOW from the White House complex while the organizations\u2019 lawsuit over access proceeds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">U.S. District Judge Timothy Kelly of Washington, D.C., issued the preliminary injunction in the wake of a hearing Thursday at which the administration contended it imposed the ban in part because of national security concerns; media organizations said it was because of \u201cviewpoint discrimination.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kelly sided with the news outlets, noting that Trump used national security as a reason for the ban after their press passes had already been revoked and ruling that it also likely violated reporters\u2019 freedom of speech and due process rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThere is practically nothing national security-related in the record connected to the President\u2019s decision to revoke Plaintiffs\u2019 hard passes to which the Court can defer,\u201d Kelly wrote in his 26-page opinion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">His order will give the outlets access to the White House until the underlying lawsuit challenging the ban is resolved. But it doesn\u2019t require the administration to allow reporters from the outlets access to the Oval Office or Air Force One \u2014 locations where the administration has blocked reporters from CNN and Politico in recent weeks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trump vowed to appeal on Truth Social before the ruling was handed down. The White House didn\u2019t immediately respond to a request for comment following the ruling.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kelly had issued a temporary restraining order lifting the ban while he weighed whether to issue an injunction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trump announced the bans of CNN, MS NOW and Politico on social media on Sept. 18, saying they were a \u201cresult of their constant \u2018reporting\u2019 FAKE NEWS!\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMedia Outlets shouldn\u2019t be able to constantly write or report FICTION and LIES when they\u2019re covering the President of the United States, the Trump Administration, or the United States of America. Other Fake News Media Outlets to follow,\u201d he wrote on Truth Social.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In court filings, the three news organizations said the ban affected 78 journalists who had \u201chard passes,\u201d meaning they had been previously screened and credentialed to work at the White House.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The outlets filed a lawsuit alleging Trump\u2019s action violated their due process rights and First Amendment protections for newsgathering and speech.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis ban could not be a more direct assault on the First Amendment nor a more blatant violation of our most fundamental constitutional principles,\u201d the suit said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The White House and Trump then began arguing that the ban was intended to address national security concerns, with Trump saying in another post that the outlets\u2019 reporting was \u201ca threat to our National Security, and must be stopped, NOW!\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judge was unmoved by that argument.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kelly said it was clear from Trump\u2019s announcement of the ban and from subsequent remarks that his motivation was content.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cPresident Trump likely banned Plaintiffs from the White House because he believes that their reporting is generally inaccurate and biased against him,\u201d Kelly wrote, finding this decision violated the journalists\u2019 First and Fifth amendment rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He noted, however, that his decision doesn\u2019t concede that Trump\u2019s concerns about accuracy and fairness are unfounded or that the government is \u201cpowerless when its true aim is to protect national security when classified information is unlawfully disclosed.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kelly cited Trump\u2019s recent remarks to Time magazine that he didn\u2019t like \u201cbad story after bad story\u201d coming from CNN, Politico and MS NOW journalists. It was, Ted Boutrous, the news outlets\u2019 attorney, had argued ahead of the decision, \u201ca confession of what amounts to viewpoint discrimination.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cPresident Trump, I\u2019ll give him credit,\u201d Boutrous said. \u201cHe\u2019s not hiding it.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In his previous decision, Kelly also found that the administration had denied the outlets due process under settled law from several cases that have made their way to the D.C. federal appeals court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The White House argued that the appeals court decisions were wrong.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMaybe\u2014but this Court is bound by D.C. Circuit precedent, full stop,\u201d Kelly wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At a hearing on the injunction Thursday, the Justice Department lawyer representing the White House, Michael Velchik, asked Kelly to lift his restraining order, calling the White House a \u201csacred place\u201d that shouldn\u2019t have to give people access just because they \u201cidentify as a reporter.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAccess to the White House is a privilege \u2014 not a right,\u201d Velchik said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Boutrous argued that the administration was engaging in impermissible and unconstitutional \u201cviewpoint discrimination\u201d because the ban was based on Trump\u2019s dislike of the outlets\u2019 reporting and because he has said he hoped the ban would force journalists to \u201cstraighten themselves out.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In court filings, Boutrous urged Kelly to ignore the national security arguments, saying they were manufactured and not what the case is really about.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Boutrous argued that \u201cthe President himself has continued telling anyone who will listen precisely what this ban is really about, most recently complaining at length in an interview with Time magazine that he banned Plaintiffs because he feels that he should not \u2018be forced to bear\u2019 what he considers \u2018constantly bad stories,\u2019 as he \u2018won the election\u2019 and has \u2018done great things.\u2019\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After Tuesday night\u2019s ruling, Boutrous said he and his clients were grateful to the court for securing their access anew.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe President has repeatedly, candidly, and consistently admitted in public that he banned our clients from the White House to punish reporting he doesn\u2019t like,\u201d he said in a statement. \u201cThe harm this ban did to our clients, the First Amendment, and the public as a whole is profound. The Court was right to enjoin the White House from enforcing this \u2018unconstitutional ban.\u2019\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Separately, the Justice Department said last week that it was investigating five major TV networks, including CNN and NBC, for potentially violating federal antitrust laws after the networks temporarily declined to provide pool coverage of Trump as a result of the ban against the three news outlets.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The pool is a rotating group of networks that share the duties of recording a president\u2019s activities during public appearances and travel.
