{"id":17693,"date":"2026-09-24T16:27:29","date_gmt":"2026-09-24T08:27:29","guid":{"rendered":"https:\/\/tingchao.xyz\/?p=17693"},"modified":"2026-09-24T16:27:40","modified_gmt":"2026-09-24T08:27:40","slug":"judge-orders-white-house-to-restore-access-for-cnn-ms-now-and-politico","status":"publish","type":"post","link":"https:\/\/tingchao.xyz\/?p=17693","title":{"rendered":"Judge orders White House to restore access for CNN, MS NOW and Politico"},"content":{"rendered":"\n<figure class=\"wp-block-image alignwide size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"469\" src=\"https:\/\/tingchao.xyz\/wp-content\/uploads\/2026\/09\/\u5c4f\u5e55\u622a\u56fe-2026-09-24-162622-1024x469.png\" alt=\"\" class=\"wp-image-17694\" srcset=\"https:\/\/tingchao.xyz\/wp-content\/uploads\/2026\/09\/\u5c4f\u5e55\u622a\u56fe-2026-09-24-162622-1024x469.png 1024w, https:\/\/tingchao.xyz\/wp-content\/uploads\/2026\/09\/\u5c4f\u5e55\u622a\u56fe-2026-09-24-162622-300x137.png 300w, https:\/\/tingchao.xyz\/wp-content\/uploads\/2026\/09\/\u5c4f\u5e55\u622a\u56fe-2026-09-24-162622-766x351.png 766w, https:\/\/tingchao.xyz\/wp-content\/uploads\/2026\/09\/\u5c4f\u5e55\u622a\u56fe-2026-09-24-162622.png 1190w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">A federal judge ordered early Thursday that the White House immediately restore access for CNN, MS NOW and Politico, saying that President Donald Trump\u2019s directive barring the three news outlets was most likely unconstitutional.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In granting a 14-day temporary restraining order reinstating the outlets\u2019 access while their legal challenge proceeds, U.S. District Judge Timothy Kelly wrote that the plaintiffs are likely to succeed in their lawsuit against the Trump administration, at least on the grounds that their credentials were revoked last week without due process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trump, he wrote, did not dispute that the outlets \u201cdid not receive notice and an opportunity to be heard before their hard passes were revoked.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The White House did not immediately respond to a request for overnight comment from NBC News.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trump had posted on social media before a Wednesday hearing in the case that he expected the \u201ctotally disloyal\u201d Kelly, whom he nominated to the bench during his first term, to rule against him \u2014 adding that \u201cas usual, we\u2019ll go for appeal.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trump announced the ban on the three news outlets in a post on Truth Social on Friday, saying it was \u201ca result of their constant \u2018reporting\u2019 FAKE NEWS!\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMedia Outlets shouldn\u2019t be able to constantly write or report FICTION and LIES when they\u2019re covering the President of the United States, the Trump Administration, or the United States of America. Other Fake News Media Outlets to follow,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Thursday\u2019s order rejected the White House\u2019s argument that banning the outlets was motivated by national security concerns, saying it offered little proof to back up the claim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cCertainly, that is not what President Trump said when he announced that he was \u2018banning\u2019 Plaintiffs from the White House \u2014 instead, he focused on the alleged lack of truthfulness and negativity of Plaintiffs\u2019 reporting,\u201d Kelly wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Speaking to reporters in the Oval Office a short time after the post, Trump referred to his directive as \u201cthe ban on the free press.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI don\u2019t want them in my office. I don\u2019t want them here,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He said the policy was not in response to a particular report, but because of \u201ccumulative stories over the last few years.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThey purposely write negative news. And they do that because they want to try and diminish the Republicans and a Republican administration,\u201d he said. \u201cIf they could straighten themselves out, I\u2019d love it,\u201d he added.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The outlets said in their suit challenging the ban that Trump\u2019s remarks show the policy was motivated by \u201cretaliation\u201d and \u201cintended to cow\u201d the outlets \u201cinto changing their reporting and threaten other journalists lest they suffer the same fate.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The \u201cConstitution does not allow a president or any other government official to deprive the press of their First Amendment rights and liberty and property interests with no notice or process based solely on that official\u2019s dislike of the content of their reporting. The ban is patently unconstitutional and should be immediately restrained,\u201d they argued.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The White House appeared to be trying to address those due process claims in letters to the news outlets on Tuesday, which told them they could \u201ccontest this initial decision\u201d in written responses by Friday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The letters accuse them of publishing \u201csensitive security information, and misinformation\u201d which \u201cundermines the President\u2019s ability to safeguard the national security.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They cited specific articles about munitions stockpiles impacted by the Iran war and sanctions against Russia, but also one about a request for $1 billion in funding for East Wing renovations that the president had said would be fully funded by donors, and another about negative \u201cvibes\u201d at the recent Republican midterm convention.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Addressing the \u201cextraordinary\u201d standard that the government argued gave it the right to revoke the outlets\u2019 passes without prior notice, Kelly wrote that the sorts of stories cited in the letters \u201care routine,\u201d and stretch back months or even years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The letters also allege the organizations have \u201cexhibited behavior in violation of the standards of professionalism and decorum expected of those given access to the White House Complex.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trump made a similar argument in a Truth Social post Monday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt is called the Oval Office, and it should be treated with Decorum, Respect, and Dignity, not defiled by Third Rate Clowns, who purposefully distort, twist, and degrade with everything they write or publish,\u201d he wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Kelly pointed to a D.C. Circuit Court case, also involving Trump, that found that for a reporter\u2019s hard pass to be revoked, the government must first publish standards of conduct that would lead to the revocation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nothing in the record demonstrates \u201cformally articulated standards,\u201d the judge wrote. And one standard the defendants \u201cappear to offer\u201d \u2014 reflected in the letters sent to the outlets \u2014 \u201cis so vague it hardly does the trick.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NBC News previously reported that Trump\u2019s Friday announcement caught a number of high-level White House aides off guard. A senior White House official defended the move to NBC News earlier this week, saying, \u201cNobody close to the President was surprised at his action to hold the fake news accountable.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Reporters Committee for Freedom of the Press, the White House Correspondents\u2019 Association and a group of 49 news and media organizations \u2014 including NBCUniversal Media LLC, the parent company of NBC News \u2014 filed a legal brief in the case Wednesday backing the three outlets.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The filing said the president\u2019s stated reasons for the ban \u201care transparently viewpoint discriminatory\u201d and \u201cinconsistent with the First Amendment.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe ban at issue in this case does exactly what longstanding D.C. Circuit precedent\u201d has said the government can\u2019t do, the filing said \u2014 \u201cprohibited three news organizations from access to the entirety of the White House and its grounds due to the content of their reporting.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It also clashes, the filing said, \u201cwith bedrock Supreme Court precedent, which recognizes that \u2018even though a person has no \u2018right\u2019 to a valuable governmental benefit,\u2019 the government \u2018may not deny a benefit to a person on a basis that infringes his constitutionally protected interests \u2014 especially, his interest in freedom of speech.\u2019\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A federal judge ordered early Thursday that the White House immediately restore access for CNN, MS NOW and Politico, saying that President Donald Trump\u2019s directive barring the three news outlets was most likely unconstitutional.
