{"id":17408,"date":"2026-09-04T09:12:43","date_gmt":"2026-09-04T01:12:43","guid":{"rendered":"https:\/\/tingchao.xyz\/?p=17408"},"modified":"2026-09-04T09:12:50","modified_gmt":"2026-09-04T01:12:50","slug":"maryland-supreme-court-puts-redistricting-referendum-back-on-november-ballot","status":"publish","type":"post","link":"https:\/\/tingchao.xyz\/?p=17408","title":{"rendered":"Maryland Supreme Court puts redistricting referendum back on November ballot"},"content":{"rendered":"\n<figure class=\"wp-block-image alignwide size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"691\" height=\"352\" src=\"https:\/\/tingchao.xyz\/wp-content\/uploads\/2026\/09\/7.png\" alt=\"\" class=\"wp-image-17409\" srcset=\"https:\/\/tingchao.xyz\/wp-content\/uploads\/2026\/09\/7.png 691w, https:\/\/tingchao.xyz\/wp-content\/uploads\/2026\/09\/7-300x153.png 300w\" sizes=\"auto, (max-width: 691px) 100vw, 691px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The Maryland Supreme Court ruled Thursday evening to keep a Democrat-led redistricting referendum on the ballot this November but with different wording.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ruling, which overturns a lower court\u2019s decision to block this proposed ballot question, is a major victory in the Democratic Party\u2019s efforts to boost their chances at reclaiming the House this fall.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If approved, the state constitutional amendment would authorize the Maryland General Assembly to grant the state\u2019s highest court \u201coriginal jurisdiction\u201d to review congressional redistricting plans.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Maryland Democrats, who control the General Assembly, have pushed for this measure, which could give their party a chance to win all eight of the state\u2019s seats in the House. The proposed amendment clarifies Maryland\u2019s strict redistricting parameters, related to a 2022 court decision that struck down a 2021 map, apply only to state Assembly districts \u2014 not congressional maps.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The proposal passed the Maryland Legislature last month and was signed into law by Gov. Wes Moore (D) shortly after.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court noted in its majority opinion that the question passed with the support of \u201cmore than three-fifths of all elected members\u201d of both houses in the Maryland General Assembly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The justices also agreed with two circuit court judgments that found the language of the constitutional amendment was misleading, ordering the original ballot language be rewritten for clarity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Moore celebrated the decision as a \u201cmassive victory\u201d in a statement released by his office Thursday evening.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe Court has rightfully reversed the lower court decisions, guaranteeing that this critical constitutional amendment will appear on the general election ballot this November,\u201d the Democrat said. \u201cThis affirms what I have said from the very beginning: the final decision on how we draw our maps belongs in the hands of Marylanders, not politicians.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The governor urged Maryland voters to support the ballot measure this fall.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He continued, \u201cWe are going to protect our democracy, ensure fair representation, and show the rest of the country that in Maryland, we do not surrender.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a dissenting opinion, Maryland Supreme Court Justice Steven Gould said he would have kept this question off the November ballot, saying it was not the high court\u2019s \u201cjob to rewrite the question for the General Assembly.\u201d His dissent to the majority opinion was joined by state Supreme Court Justice Glenn Harrell.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Additionally, Gould said the majority\u2019s proposed ballot question rewrite \u201cremains misleading.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMaryland voters reading it would not understand that the criteria being removed include the guarantees of the Declaration of Rights\u2014the collection of sacred rights that protect Marylanders against government overreach,\u201d Gould wrote in his dissent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nicole Beus Harris, the chair of the Maryland Republican Party, said in a statement shared on social media that state GOP leaders are \u201cdeeply disappointed\u201d by this ruling.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cNevertheless, we are confident we can defeat this amendment at the ballot box in November,\u201d she said.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Maryland Supreme Court ruled Thursday evening to keep a Democrat-led redistricting referendum on the ballot this November but with different wording.
