A federal judge in Maryland on Wednesday blocked an executive order from President Trump that again seeks to restrict birthright citizenship.<\/p>\n\n\n\n
U.S. District Judge Deborah Boardman granted a preliminary injunction in a case brought by two immigration advocacy groups that had also challenged the Trump administration\u2019s initial attempt last year to limit who is eligible for automatic citizenship at birth.<\/p>\n\n\n\n
Boardman wrote in a 35-page opinion that the new directive was \u201calmost certainly unconstitutional as applied to the certified class,\u201d pointing to the Supreme Court decision in June that struck down Trump\u2019s Day 1 executive order.<\/p>\n\n\n\n
\u201cThis Court must, once again, preliminarily enjoin enforcement of the President\u2019s most recent attempt to strip the right to citizenship from them,\u201d Boardman, a Biden appointee, wrote.<\/p>\n\n\n\n
Her order prohibits the administration from enforcing the new restriction against any child born after February 19, 2025, to one or both parents who were not lawfully in the country at the time.<\/p>\n\n\n\n
The Hill has reached out to the White House for comment.<\/p>\n\n\n\n
Five of the Supreme Court\u2019s justices affirmed in June that the 14th Amendment guarantees automatic citizenship to nearly all children born on U.S. soil, including those born to parents who are in the country unlawfully. Justice Brett Kavanaugh also voted to block Trump\u2019s order but only on statutory grounds.<\/p>\n\n\n\n
About a month later, the president issued a new pair of executive orders aimed at curbing what the administration refers to as \u201cbirth tourism,\u201d which involves traveling to the country for the primary purpose of giving birth on U.S. soil.<\/p>\n\n\n\n
The orders also seek to expand the definition of who cannot get automatic citizenship to include children born to a parent who is an \u201calien enemy or member of foreign terrorist organizations,\u201d as well as several other categories of individuals.<\/p>\n\n\n\n
CASA, Inc., and Asylum Seeker Advocacy Project, Inc. \u2014 which secured a nationwide injunction from the same court last year \u2014 asked the judge to intervene again.<\/p>\n\n\n\n
The Justice Department defended the new restrictions as narrower than what was previously struck down and claimed that the plaintiffs\u2019 case was premature because the president\u2019s order has not yet been implemented.<\/p>\n\n\n\n
Boardman noted that she found those arguments \u201cunpersuasive\u201d and said that the administration was relying on a \u201cdistorted interpretation\u201d of the Supreme Court\u2019s ruling.<\/p>\n\n\n\n
\u201cThough the defendants may not like it, the Barbara Court\u2019s conclusion was clear: The children in the class \u2018satisfy both elements of the Citizenship Clause\u2019\u2014place and jurisdiction\u2014and they are thus \u2018citizens at birth,\u2019\u201d the judge wrote.<\/p>\n","protected":false},"excerpt":{"rendered":"
