A federal judge ruled Wednesday that E. Jean Carroll can receive the $5.8 million awarded to her after a 2023 jury found that President Donald Trump sexually abused her in 1996 and later defamed her when he denied her allegations.<\/p>\n\n\n\n

After the Supreme Court refused last week to hear the president\u2019s appeal of the award, U.S. District Judge Lewis Kaplan directed the release of the money, along with the interest accrued since the verdict, from a court escrow account.<\/p>\n\n\n\n

The move came after Trump\u2019s attorneys sought to delay the payment for what would have been at least several more months, asking the judge to give them more time before releasing the money while they ask the high court to reconsider its decision.<\/p>\n\n\n\n

Asked about Kaplan\u2019s order, a spokesperson for Trump\u2019s legal team said in a statement, \u201cThe American people stand with President Trump as they demand an immediate end to all of the Witch Hunts, including the Democrat-funded travesty of the Carroll Hoaxes.\u201d<\/p>\n\n\n\n

Trump\u2019s attorneys filed a notice of appeal of the judge\u2019s order hours after it was released. They\u2019re asking the 2nd U.S. Circuit Court of Appeals for an immediate temporary pause on the order.<\/p>\n\n\n\n

Lawyers for Carroll said in a filing last week that their client, whom Trump was found liable for sexually abusing and defaming, has already waited long enough.<\/p>\n\n\n\n

Kaplan shared that view in his ruling Wednesday, saying Trump \u201chas been stalling this case for years.\u201d<\/p>\n\n\n\n

\u201cA jury unanimously concluded that he sexually abused and defamed plaintiff and awarded her damages accordingly. The judgment on that verdict has been upheld on appeal,\u201d the judge wrote, adding that Trump\u2019s request for a broader \u201crehearing has been denied\u201d and the Supreme Court without dissent declined to intervene.<\/p>\n\n\n\n

\u201cIt\u2019s time for him to \u2018do equity\u2019 and pay the judgment,\u201d Kaplan wrote.<\/p>\n\n\n\n

The case arose from a 2022 suit Carroll filed in New York alleging that Trump sexually assaulted her in the dressing room of a Manhattan department store after a chance encounter in 1996. The defamation claims stemmed from comments he made about her after his first term in office, including calling her claims a \u201ccon job\u201d and \u201choax.\u201d He maintains he does not know Carroll and didn\u2019t commit any wrongdoing.<\/p>\n\n\n\n

Trump\u2019s attorneys contended the payment freeze should remain in effect until the Supreme Court decides on their request for a reconsideration, and said a failure to do so would potentially subject their client to irreparable harm.<\/p>\n\n\n\n

They argued that Carroll, who is 82, \u201cfaces only temporary delay\u201d for which she\u2019d collect additional interest \u201cunless judgment is overturned on appeal.\u201d<\/p>\n\n\n\n

Trump, meanwhile, \u201cfaces unrecoverable loss\u201d once Carroll collects because she \u201chas repeatedly stated that she intends to give away all funds that she collects from him,\u201d and \u201conce those funds are distributed to third parties, they likely cannot be recovered,\u201d they said.<\/p>\n\n\n\n

Carroll\u2019s lawyers had noted that Trump\u2019s lawyers had agreed in 2023 that the money could be released if the Supreme Court refused to hear the case, an agreement that was signed off on by the judge.<\/p>\n\n\n\n

Trump\u2019s attorneys argued the case was technically still before the Supreme Court because they asked the high court to reconsider the refusal to hear the case. Such requests are rarely granted, and Carroll\u2019s lawyers noted it could take several months to get a response from the court.<\/p>\n\n\n\n

Carroll first went public with her abuse allegations in 2019. She sued Trump for defamation that same year, but the case was tied up in appeals for years over issues involving presidential immunity.<\/p>\n\n\n\n

A jury awarded her an $83.3 million judgment when that case eventually made it to trial in 2024. A federal appeals court rejected Trump\u2019s bid to toss that verdict earlier this year, and his legal team told the Supreme Court it will seek permission to challenge that case in the high court as well.<\/p>\n\n\n\n

Trump\u2019s legal team said that the second pending challenge is why the Supreme Court should reconsider the $5 million case. They argue that the jury was improperly shown Trump\u2019s statements blasting Carroll from when he was president in 2019, statements they contend in the other case were protected by presidential immunity and therefore should not have been shown to the jury.<\/p>\n\n\n\n

They said they didn\u2019t raise the issue earlier because the precedent they\u2019re relying on \u2014 the Supreme Court\u2019s 2024 ruling that gave Trump some presidential immunity in his federal election interference case \u2014 came down too late for their appeal.<\/p>\n\n\n\n

Carroll\u2019s attorneys said in a court filing last week that Trump appeared to be trying \u201cto buy time so he can try to concoct some new basis to put off paying Plaintiff.\u201d<\/p>\n\n\n\n
