Americans do not think the president should have the ability to act unconstrained by the courts and Congress, according to new research on U.S. attitudes on checks and balances. But views on that question are divided by party amid President Donald Trump\u2019s running battle with judges over his administration\u2019s policies.<\/p>\n\n\n\n

A growing list of policy changes ordered by Trump since he was sworn in have been at least temporarily blocked by federal judges after being challenged in court, including his moves to end birthright citizenship, give Department of Government Efficiency employees access to the Treasury Department\u2019s payment systems, reduce the indirect cost recovery rate for all grants issued by the National Institutes of Health, eliminate the U.S. Agency for International Development, and more.<\/p>\n\n\n\n

According to a study by the nonpartisan Congressional Research Service, at least 17 policies were blocked this way in the first two months of the second administration, compared to 19 such blockages during the entire Obama administration and 24 during the Biden administration.<\/p>\n\n\n\n

The figures underscore how much of what the Trump administration has done has been contested in court \u2014 and Trump and his allies have pushed back against the judiciary as judges have blocked their policies. Trump called for a judge who ruled against him to be impeached, prompting a rare rebuke from Chief Justice John Roberts. Vice President JD Vance argued on X, \u201cJudges aren\u2019t allowed to control the executive\u2019s legitimate power,\u201d while border czar Tom Holman said \u201cI don\u2019t care what judges think\u201d when asked about judicial efforts to block deportations.<\/p>\n\n\n\n

But does the public feel the same way \u2014 that a president should have the right to ignore the wishes of the courts and Congress?<\/p>\n\n\n\n

To answer this question, researchers at the Annenberg Public Policy Center conducted a study last month as part of the center\u2019s Institutions of Democracy panel survey, interviewing a nationally representative sample of 1,363 Americans from March 6-16 on six questions designed to measure their support for the system of checks and balances.<\/p>\n\n\n\n

The data was remarkably clear: Americans do not think the president should have the ability to act unconstrained by the courts and Congress. With one small exception, a majority of the public rejects the claim that presidents should have expansive powers. While Republicans are the most supportive of greater executive power as Trump currently sits in the Oval Office, most of them still reject claims of unilateral authority.<\/p>\n\n\n\n

Instead, Democrats, Republicans and independents alike believe that the courts and Congress should be able to check the president\u2019s actions. The one partial exception is that a majority of Republicans think that the president should have the authority to decide how executive agencies should implement the law. But even here, it is just a slight majority, and it is arguably a more subtle item than the other questions.<\/p>\n\n\n\n

Only 16% of respondents, for example, said a president should be able to ignore court decisions he believes intrude on his constitutional authority, including 27% of Republicans. On the question of whether a president should have the right to enact policies without Congress voting on them, 20% of respondents agreed, including a third of Republicans.<\/p>\n\n\n\n

More broadly, 58% overall agreed with the statement that courts prevent elected officials from abusing their power, including 51% of Republicans. And 84% overall agreed that courts play a vital role in our system of government, with little variation across partisan lines.<\/p>\n\n\n\n

The fact that the public \u2014 including Republicans, despite Trump\u2019s high levels of support from within his party \u2014 doesn\u2019t support efforts to ignore and cow the other branches is important, especially at a moment when so many important challenges to executive action are working their way through the courts.<\/p>\n\n\n\n

The fact that judges can block these sorts of policies is an example of America\u2019s system of checks and balances in action: Individuals can sue and ask a court to review actions by the administration, and if the court rules that the action violates the law or the U.S. Constitution, they can block those policies from being enacted.<\/p>\n\n\n\n

The limitation for the courts is that they cannot independently enforce their rulings, but instead depend on the president, Congress and the public believing in our constitutional system enough to obey them. But as Thomas Paine wrote in \u201cCommon Sense\u201d amid the birth of the United States, \u201cin America the law is king. For as in absolute governments the King is law, so in free countries the law ought to be king; and there ought to be no other.\u201d<\/p>\n\n\n\n
